2023 Face Mask Directive (Selangor)

Selangor State Government issued a state wide directive mandating all food traders, providers, and handlers to wear face mask effective 1st of January 2023.

According to Kajang Municipal Council’s President Najmuddin Jemain, the ruling was issued on 7th September 2022 during the State Executive Council Meeting.

All hawkers, food providers, and handlers in Selangor shall comply with the directive as one of the ways to maintain hygiene.

Besides wearing face mask, all food handlers shall also undergo Food Handler Training and get vaccinated against typhoid before handling any food items in a food premise.

Currently food handlers have option to choice either to attend onsite physical (face-to-face) session or online session of Food Handler Training.

CCM, Business License and Food Premise Registration – are they the same?

SSM Lesen Pendaftaran Fosim KKM. As a food business operator, it is important for you to ensure that all business documentation needed are complete and ready for inspection at all times. This is the responsibility that has to be fulfiled by every food business operator. Having these documents demonstrates that a business is legally recognized and validated, which boosts its credibility and instills confidence in its products or services among customers.

What are the required documents that food business operators need to have, and how can they obtain them?

3 documents that are required for a food business are:

  • Business Registration Certificate / Company Incorporation Certificate / Certificate of Registration for Limited Liability Partnership – usually known as SSM
  • Business License issued by Local Authority
  • Food Premise Registration – also known as FoSIM Registration

The public often refers to these documents as “licenses,” but in reality, they serve different purposes and are issued by different government agencies. Let’s examine each of the above-mentioned documents individually.

1. Business Registration / Company Registration  / Limited Liability Partnership Registration

In Peninsular Malaysia and the Federal Territory of Labuan, all businesses must be registered with the Companies Commission of Malaysia – CCM. CCM is also known as SSM (it’s Malays abbreviation) among the locals. CCM is a government agency under the Ministry of Domestic Trade and Cost of Living that oversees compliance with corporate laws and business registration in Malaysia. Traders and entrepreneurs can register their businesses or companies according to their needs. SSM will issue a Business Registration Certificate (Form D), Company Incorporation Certificate (Form 9), or Limited Liability Partnership Registration Certificate based on the type of entity being registered.”

It is the responsibility of the business owner to obtain a business license, permit, or letter of authorization from the local authority or relevant agency that corresponds to the type or activity of the business, even if the business has already been registered with CCM.

2. Business License or Premise License

Food business operator must also meet the requirements set by the Local Authority. As a general rule, business owners need to apply for a business license or premises license with the local authority in the area where the business is located. When applying, the applicant may need to provide supporting documents such as a copy of the business/company registration, a Food Handler Training attendance certificate, a typhoid vaccination card, and sometimes a food premises registration certificate.”

3. Food Premise Registration

Food premises operating in Malaysia must be registered with the Malaysian Ministry of Health (MOH). The requirement to register food premises is stated in Regulation 3, Food Hygiene Regulations 2009, while the types of premises that need to be registered are listed in the First Schedule of the same legislation. Food business entrepreneurs can register food premises through the website Food Safety Information System of Malaysia (FoSIM), After successful registration, the Premises Registration Certificate can be printed through the FoSIM system. Food business operator should keep in mind that the certificate must be displayed prominently at the food premises and not kept in storage

Food premises registration only applies to business premises that involves food preparation. Business premises that do not have food preparation do not need to be registered with the MOH.

Therefore, it is clear that these three documents are distinct and governed by different government agencies. As a food business operator, you must complete the following steps:

  1. register your business
  2. apply for a premises license
  3. register your food premises.

Home-based Food Vendors, Food Handler Certificate, Typhoid Vaccination and FoSIM 2022

Who is a Home-based Food Vendors?

Home-based food vendors are food entrepreneurs who prepare food at home for the purpose of selling the food. Many home-based food businesses are still unclear about the requirements that need to be fulfilled with when running a food business from home.

The Food Safety and Quality Division, Ministry of Health Malaysia has published the Food Safety Guidelines for Home-Based Food in March 2021 as a reference to enhance the knowledge of home-based food vendors.

Among the basic requirements as a food vendor / handler:

  1. Register food premise in the Food Safety Information System of Malaysia (FoSIM).
  2. Get the anti-typhoid vaccination
  3. Undergo Food Handler Training (FHT) with any Food Handler Training School (SLPM) recognized by the Ministry of Health Malaysia
  4. Implement good food hygiene and safety practices
  5. Conduct self -examination as stated in the Self -Checklist of Home-based Food Vendors

Food Premise Registration on FoSIM Website

Food premises operating in the Malaysia must be registered with the Ministry of Health. Home-based food premises are also no exception to this requirement. Home kitchens involved with home-based food preparation are included in category P3 – Premises Where Food Is Prepared, Processed, Stored And Served For Sale. Registration can be made by the food business operator on the Food Safety Information System of Malaysia (FoSIM) website Food Safety Information System of Malaysia.

Anti-typhoid vaccination

All food handlers working in Malaysia need to obtain the anti-typhoid vaccination. Typhoid fever is a food-borne infection caused by the bacterium Salmonella typhi. The disease can be spread through food or water contaminated with S.typhi bacteria. These bacteria are commonly carried in the blood and intestinal tract of infected humans.

Regulation 31 (1), Food Hygiene Regulations 2009 states that, all food handlers must be vaccinated by a registered medical practitioner. The vaccine meant in this regulation to here is the anti-typhoid vaccine.

Food Handler Training Course

All food handlers working in Malaysia must undergo Food Handler Training and obtain a Food Handler Training certificate at a Food Handler Training School recognized by the Ministry of Health Malaysia. This is clearly stated in Regulation 30 (1) of the Food Hygiene Regulations 2009.

The content of the Food Handler Training course covers all the things that need to be practiced by food vendors and food handlers of home-based food for sale. Course participants will be guided by experienced instructors on how to implement the requirements that have been stated.

Hygienic and Safe Practices

The hygienic and safe food handling practices includes:

  1. Basic personal hygiene practices
  2. Usage of water and ice
  3. Selection and purchasing of raw materials
  4. Storage of raw materials
  5. Process control during food preparation
  6. Food labeling
  7. Transportation and distribution
  8. Pest control
  9. Self -inspection

Home-prepared food vendors need to reassure customers and consumers that home-based food is clean, safe and comparable to meals prepared in commercial kitchens. Therefore, as a first step, food operators and handlers need to understand their roles and responsibilities.

4 Types of Food Premises That Are Required To Be Registered With MOH

MOH food premise registration. Food premises operating in Malaysia are required to be registered with the Ministry of Health. According to Food Act 1983, a food premise means premises used for or in connection with the preparation, preservation, packaging, storage, conveyance, distribution, or sale of any food, or the relabelling, reprocessing, or reconditioning of any food. Premises that are required to be registered are listed in the First Schedule of Food Hygiene Regulations 2009 (FHR 2009).

4 types of premises that are listed in the First Schedule are as follow:

P1 – All food premises involved in manufacturing of food.

Examples of premises that are involved in the manufacturing of food are rice mills, bakeries, canned food processors and etc.

P2 – All food premises involved in catering or mass catering of food.

Examples of premises that are involved in catering and mass catering of food are school hostel kitchen, hospital kitchen, hotel or resort kitchen, college or institutional kitchen, etc.

P3 – All premises where food is prepared, processed, stored, or served for sale.

Examples of premises where food is prepared, processed, stored, or served for sale are eateries, cafes, restaurants, canteen, food stalls, hawkers, etc.

P4 – All vehicles from which ready-to-eat food is sold

Examples of vehicles from which ready-to-eat food is sold are food trucks, bicycle food peddlers, van food hawkers, etc.

Registration can be done by food business operators on their own at Food Safety Information System of Malaysia website. Premise registration certificate can be printed out once the registration is completed. The certificate is valid for three (3) years from the date of issuance. Application for renewal can be made at least 30 days before the date of the certificate expiry via the same website.

Not registering food premises is an offense and it is compoundable under Food Hygiene Regulations 2009. Anyone who commits an offense shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years.

Therefore, food business operators need to ensure all their food premises are registered with MOH.

Sekolah Latihan Pengendali Makanan, atau pun lebih dikenali dengan nama singkatannya SLPM, merupakan organisasi yang telah mendapat akreditasi, iaitu pengiktirafan, daripada Kementerian Kesihatan Malaysia (KKM) untuk melaksanakan kursus Latihan Pengendali Makanan kepada semua pengendali makanan yang bekerja di Malaysia.

Jadi, persoalaannya adalah, bagaimanakah kita tentukan sama ada satu-satu SLPM itu diiktiraf oleh KKM atau pun tidak?

1. Sijil Latihan Pengendali Makanan

Semua pengendali makanan yang bekerja di premis makanan perlu menghadiri kursus Latihan Pengendali Makanan di mana-mana Sekolah Latihan Pengendali Makanan yang diiktiraf oleh Kementerian Kesihatan Malaysia. Sijil kehadiran kursus akan diberi kepada peserta yang berjaya mengikuti keseluruhan kursus selama 3 jam.

2. Kad suntikan vaksin anti-tifoid

Semua pengendali makanan yang bekerja di premis makanan perlu mendapatkan suntukan vaksin anti-tifoid daripada mana-mana pengamal perubatan yang berdaftar. Kad suntikan vaksin akan dikeluarkan kepada pengendali makanan yang telah mendapatkan pelalian.

3. Perakuan Pendaftaran Premis Makanan

Semua premis makanan yang beroperasi di Malaysia perlu didaftarkan dengan Kementerian Kesihatan Malaysia. Perakuan Pendaftaran Premis Makanan yang dimaksudkan adalah dokumen yang dicetak dari laman sesawang Food Safety Information System of Malaysia (FOSIM) selepas sesebuah premis makanan berjaya didaftarkan.

Online Food Handlers Training During Movement Control Order (MCO) Period

MCO Food Handler Training. Win Synergy Training Sdn. Bhd. has obtained permission from the Food Safety and Quality Division (FSQD), Ministry of Health Malaysia (MOH) to conduct the Online Food Handler Training course during the Movement Control Order (MCO) period.

The fee and duration of the online course are still the same as the face-to-face session, which is RM50.00 per participant for a period of 3 hours. The 3 -hour course duration does not include system setup and break time. However, the number of participants per class is limited to only 10 people for online sessions compared to 30 people per session for face-to-face classes.

Participants can attend online courses using a desktop computer, laptop, tablet, or smartphone. Course notes and reference materials will be distributed electronically to all participants. For this online course, participants will also have to answer quiz questions after completing each learning topic. This is a new requirement stipulated by FSQD apart from the usual pre-training and post-training tests. Apart from that, the Food Handler Training School (FHTS) which organizes the online course must record the entire training session and send the training recording to the State Health Department (JKN) for review no later than three (3) days after the course is conducted.
